The Statute of Forensic Medicine Organization of Developing Countries (FMODC)
The representatives of forensic medicine of the participating countries at the Regional Meeting of the Heads of Forensic Medicine held on February 25-27, 2018 in Tehran to establish the Forensic Medicine Organization of Developing Countries (FMODC) and are composed of the following materials:
The Forensic Medicine Organization of Developing Countries (FMODC) is an international specialized scientific organization with a jurisdiction consisting of forensic medicine institutions in all member countries. It has an independent legal identity, rules and regulations that do not interfere with local member countries internal rules and regulations.
FMODC is established to:
- Promote forensic medicine in member countries to the highest level of international standards.
- Facilitate and enhance scientific and technical exchange among its members.
- Provide standards, manuals and guidelines for forensic medicine related processes and creating unanimity among member countries in this regard.
- Provide appropriate solutions for new challenges in forensic medicine.
- Provide research and educational opportunities for nominees from member countries.
Article (3): The main organizational chart of FMODC includes:
- General Assembly
- Permanent Secretariat
- General Secretary
- Executive Committee
Subordinate positions will be created upon decision by the general assembly.
Article (4): The head of the organization is a two-year period held by one of the heads of forensic medicine of the member states.
Article (5): The general assembly consists of representatives of member countries and is charged with developing the organization’s strategy and policies. Each member country has the right to have a voting representative in the general assembly.
Article (6): The general assembly meet at least every two years. Special meetings will be held upon the request of the president of the assembly or 50% of the general assembly.
Article (7): The head of the organization following the general assembly is assigned to the head of forensic medicine of the host country and his presidency will continue until the next general assembly.
Article (8): The general assembly decides on the venue of the next meeting during each convention of the general assembly.
Article (9): All resolutions and regulations should be ratified by the general assembly.
Article (10): The secretariat shall develop the mechanism for procedures development to be presented to and enacted by the general assembly.
Article (11): The permanent secretariat of FMODC (herein after called the secretariat) will be located in Tehran and headed by a nominee who will be assigned for a period of 4 years by the president after approval of the general assembly. Re-election of the head of secretariat is permissible. Dismissal of person will be possible only upon approval by the general assembly and the president.
Article (12): The organizational chart of the secretariat is to be submitted by the head of secretariat and ratified by the general assembly and approved by the president.
Article (13): A separate agreement regarding the location of the secretarial (i.e.: Tehran) will be signed between the government of Islamic Republic of Iran and FMODC.
Article (14): The official languages of the secretarial include Farsi, Arabic and English, which will be used in all official correspondence. Using other languages is to be decided by the general assembly.
Article (15): All Developing countries can become members of FMODC, through submitting an official request to the secretariat, which will be decided on by the general assembly and the president.
Article (16): FMODC can grant membership to persons or organization with similar interests in order to promote its scientific level or strengthen its financial bases as observers with no voting right.
Article (17): FMODC can sign agreements of cooperation with non-member countries, organizations or persons in order to attain its objectives.
Article (18): FMODC can invite representatives of governmental or non-governmental organizations or individuals involved in activities similar to those of FMODC to cooperate with it or as observers during the meetings of the general assembly or any other time as necessary.
Article (19): Budget procurement will be done through various resources, including: membership fees, grants by organizations, governments and income generating activities. The amount of membership fee of different countries is based on their particular circumstances and determined by the proposal of the Secretary-General and approved by the General Assembly.
Leaving or Resignation
Article (20): Every member country willing to resign from the organization can submit a request to the secretariat, which will be executed upon approval by the general assembly, provided that the country fulfils its payment duties.
Interpretation and modification(s)
Article (21): In case of dispute, regarding the contents of this constitution, the legal committee assigned by the organization will be the referee.
Article (22): Modification and correction of the contents of this constitution will be possible only upon approval of the general assembly.
